The UAE’s maternity leave regulations, detailed in Article 30 of Federal Decree-Law No. 33 of 2021, are designed to provide support and protection to female employees before and after childbirth. These provisions ensure financial stability, job security, and essential flexibility during this period for mothers. Below is an overview of the key maternity entitlements and regulations in the UAE.

  • Paid Maternity Leave – A female employee is entitled to 60 calendar days of maternity leave. The first 45 days are at full wage, followed by 15 days at half wage.

  • Unpaid Leave - An additional 45 days of unpaid leave is allowed in cases where the employee or child experiences health complications.

  • Extended Leave for Special Cases – If a child is unwell or requires continuous special care, employees can receive an additional 30 days of paid leave after the formal maternity leave ends and an additional 30 days of unpaid leave if needed.

  • Job Protection – Employers cannot terminate or notify staff of termination due to pregnancy or maternity leave. Employees returning from maternity leave are entitled to their position or an equivalent role.

  • Other Statutory Benefits - Taking maternity leave does not impact an employee’s entitlement to annual leave, sick leave, or any other statutory leave. Employees remain eligible for other leave types as per company policy and UAE labour law.
